Terms of Service

The rules that govern your use of the Showfer platform.

Please read these Terms of Service ("Terms") carefully before using Showfer. By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use Showfer.

1. About Showfer

Showfer, Inc. ("Showfer") operates a technology platform that facilitates connections between licensed real estate agents who need showing coverage ("Requesting Agents") and licensed real estate agents available to perform those showings ("Showing Agents"). Showfer is a marketplace platform — we do not employ showing agents, and we do not perform real estate brokerage services. All users must hold an active real estate license in their operating state.

3. Account Registration

You must create an account to use Showfer. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. Showfer reserves the right to suspend or terminate accounts that contain inaccurate or misleading information.

4. Agent Verification

All Showing Agents are subject to license verification before they may accept jobs. Showfer checks license status through publicly available state real estate commission records. You authorize Showfer to perform these checks periodically during your time on the platform. If your license lapses or is suspended, you must immediately stop performing showings through Showfer and notify us at support@showfer.com. Performing showings with an invalid license is a violation of these Terms and may expose you to regulatory and legal liability.

5. The Showfer Marketplace

Requesting Agents may post showing requests specifying the property address, date and time, and any relevant instructions. Showfer's algorithm will match the request with available Showing Agents based on proximity, ratings, and availability.

Showing Agents may view and accept available showing jobs in their area. By accepting a job, you commit to appearing at the property at the agreed time, conducting the showing professionally, and providing a recap to the Requesting Agent promptly upon completion.

Showfer does not guarantee the availability of agents in all markets or at all times.

Showfer reserves the right to remove users who violate these standards, with or without prior notice.

9. Ratings and Reviews

Both Requesting Agents and Showing Agents may leave ratings after each completed showing. Ratings are used to inform future matching decisions and are displayed on user profiles. Ratings must reflect genuine experiences. Showfer may remove ratings that appear fraudulent or that violate these Terms.

10. Independent Contractor Status

Showing Agents using Showfer are independent contractors, not employees, agents, or partners of Showfer. Nothing in these Terms creates an employment, joint venture, or partnership relationship. Showing Agents are responsible for their own taxes, insurance, professional compliance, and business expenses. Showfer does not withhold taxes from payments to Showing Agents. You may receive a Form 1099 if your earnings exceed applicable thresholds.

11. Liability and Insurance

Each agent is responsible for maintaining appropriate errors and omissions (E&O) insurance and any other insurance required by their brokerage or state law. Showfer does not provide insurance coverage for showings conducted through the Platform. Showfer's liability to any user is limited to the amount paid to or by that user through the Platform in the 90 days preceding the claim, to the maximum extent permitted by applicable law.

12. Disputes Between Users

Showfer provides a framework for users to resolve disputes (such as quality concerns or no-shows) through our in-app support process. Showfer may, at its discretion, mediate disputes but is not obligated to do so and is not liable for the outcome of any dispute between users.

13. Intellectual Property

The Showfer Platform, including its software, design, trademarks, and content, is owned by Showfer, Inc. and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our express written permission.

14. Termination

You may close your account at any time by contacting support@showfer.com. Showfer may suspend or terminate your account at any time for violation of these Terms, for inactivity, or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination — including payment obligations, dispute resolution, and limitation of liability — will survive.

15. Modifications to Terms

Showfer may update these Terms at any time. We will provide at least 14 days' notice of material changes via email or in-app notification. Your continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the changes.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Platform that cannot be resolved informally will be resolved through binding arbitration under the rules of the American Arbitration Association, on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.
